Aam Aadmi Party files complaint 

against Sharad Pawar 

and Gopinath Munde


The Aam Aadmi Party Maharashtra has filed complaints as of 24th March 2014 with the Election Commission against Sharad Pawar demanding derecognition of the Nationalist Congress Party and against Gopinath Munde of the Bharatiya Janata Party demanding immediate disqualification.

Mr. Sharad Pawar, in presence of his party leadership including Mr. Ajit Pawar, on 23.03.2014 at Navi Mumbai in a Public Meeting addressed Headloaders (Mathadi workers) and called upon them to vote at Satara on 17.04.2014 and then again at Mumbai on 24.04.2014. He further stated that such workers should remember to wipe off the ink mark before voting again. Mr. Sharad Pawar, Mr. Ajit Pawar and the leaders of his party present at the dais conferred before making such statement thereby calling for double/bogus voting. The statement has been widely reported in the media and a video clip thereof is available on youtube.com.
 
Hence, Mr. Sharad Pawar, Mr. Ajit Pawar and party leaders present on the dais and visible in the video clip available on Youtube.com are guilty of Electoral Offences of Undue Influence u/s 171C of I.P.C., Criminal Conspiracy u/s 120B of I.P.C., Corrupt Practices u/s 123 (2) of Representation of People Act, 1951 and violation of Section 1.4 of Model Code of Conduct.
 
AAP has asked for;
-    FIRs to be registered against Mr. Sharad Pawar, Mr. Ajit Pawar and party leaders present on the dais and visible in the video clip.
-    De-recognition of NCP.
-    Disqualification of all NCP candidates for Lok Sabha poll with immediate effect.
-    Taking measures to check double voting and
-    Pending enquiry to deny to the NCP any permission to hold public meeting/processions/rallies etc..
 
The complaint filed with E.C.I., State Electoral Officer, State of Maharashtra, District Election Officer, Thane and Commissioner of Police is enclosed herewith

Mr. Dhananjay Munde has made a statement that he facilitated bogus voting in favour of Gopinath Munde in 2009 polls in Beed District. The statement has been widely reported in the media.
 
Hence, Mr. Gopinath Munde and Mr. Dhananjay Munde are guilty of Electoral Offences of Undue Influence u/s 171C of I.P.C., Criminal Conspiracy u/s 120B of I.P.C., Corrupt Practices u/s 123 (2) of Representation of People Act, 1951 and violation of Section 1.4 of Model Code of Conduct.
 
AAP has asked for ;
-    Disqualification of Mr. Gopinath Munde and setting aside of his election of 2009 with retrospective effect.
-    Disqualification of Mr. Dhananjay Munde and setting aside of his election as Member of Legislative Council with retrospective effect.
-    Taking measures to check double voting and

-    Registration of FIRs against Mr. Gopinath Munde and Mr. Dhananjay Munde for the offences as aforestated.
